What will my likely sentence be for 3 felony theft by deception, theft by unlawful taking and receiving stolen property?

I was caught stealing from my place of work. Over the course of 6 months I stole $16k worth of goods. When I was questioned I confessed to everything and cooperated the whole time. This is my first time being arrested since I was a kid which was expunged. I'm now 26 and i'm looking at Felony 3 Theft by deception, Felony 3 Theft by Unlawful Taking, Felony 3 Receiving Stolen Property. I'm currently waiting to find out when my arraignment date is. I don't have much money so I was hoping to get a public defender. This all happened in Springfield, PA. What is the likelihood of me getting a Public Defender, also what is the likelihood of me being able to work out a plea deal with the DA. I want to make restitution but at the same time, I want to avoid jail time.

It is hard to say if your financial criteria meet the level to qualify for a PD but if you are now unemployed my guess is that you would be eligible for a PD. You should apply for a PD ASAP. Do not wait until your arraignment. A felony 3 is punishable by up to 7 years in prison. This being your first offense I would say that prison is a definite possibility but not a foregone conclusion and I can't foresee you getting the maximum sentence. Sentencing is done by guideline in PA and The Max just does not apply for a first offense. Certainly your cooperation and payment of restitution will go a long way to helping you but a word of caution. Doing anything including payment of restitution could be used against you in court and you should consult with whomever represents you in this matter before doing so.

Although it is a felony offense, you could get probation as long as your prior record is not serious. The public defender office in Delaware County has very good attorneys. However, if you can swing it, I would contact several private attorneys to discuss your case and their fee. Good Luck.
