A parent can give permission to a minor to marry prior to 18; however, you may have criminal issue inssue in this matter. Since the girl is only 16 and the partner is more than 2 years her senior, this situation fits the definition of statutory rape and can have criminal consequences. Contact an attorney as soon as possible for more specific advice.

I agree with the other attorney, to marry in Texas, a 16 yr. old needs parental permission. Additionally, I will not address the possible criminal issue of their age difference. I am not a criminal lawyer. However, the 22 yr. old should be worried about being convicted of being a child molestor. Being pregnant is irrelevant.

With regard to criminal liability, it does not matter whether or not the couple marry. If the child belongs to the 22 year old and he is named on the birth certificate, it is possible that the hospital will contact police after the birth. In Texas, if the parties are within 3 years o.f age of each other then it is a defense to the crime of sexual assault. (Because she is 16, she could not legally consent to have sex. Even if she did consent, the consent is no good because the law says so until she turns 17 - legal age.) If the parties are 3 years and a day or more apart in age and the younger one is under 17, then the older one can be charged with sexual assault
