Will a theft C - less than $50 show up on a background check?

My daughter was charged with a theft C (less than $50) and the court gave her deferred disposition. She paid the fine, took a theft class, and did the community service. Is this off her record? If not, what does she need to do? Will this affect her future employment?

Without further action on your part the state and national criminal databases will continue to show that she had been arrested for theft and yes the will have a negative impact on future employment. She is eligible to have her record sealed with an order of non disclosure and may be eligible to have her record expunged depending on the actual facts of her case. Actually, with deferred disposition, she can have her record cleared completely - EXPUNGED. This is not something that is simple to do so you need to obtain the assistance of lawyer in the area in which the case was prosecuted. Once you have the case expunged, it IS off her record and will not be available for prospective employers (or the police or apartment complexes) to see.
