You do not need to be pulled over in the no passing zone for the ticket to be valid. You merely need to be observed passing in a no passing zone for the state to make the case against you.

The State is required to prove the charges on the ticket. If the officer made a mistake by not annotating the word "no passing " zone on the ticket, the ticket will generally still be valid. Also, typically the officer will also write down the code section of the charge he is making out against you. What generally controls is if you have been placed on notice of what you are charged with. If you have a valid defense, consult with a local attorney.
