My 15-year-old was arrested in Pensacola yesterday and charged with possession of a small amount of marijuana.

He has one prior offence for shoplifting. What will likely happen to him sentence wise? Will he have to go to court? Who decides that? What happens, in terms of procedures, when he goes to court. Can we have a lawyer represent him? What kind of factors will influence the judge in his sentencing. Can I be held liable in some way for his conduct. Thank you.
Your son will be treated as a juvenile and be required to appear in juvenile court unless the State chooses not to file a petition or a diversion is reached in advance. He is probably looking at a diversion program with drug offender counseling or probation. I recommend you hire counsel asap so they can contact the State and and try to minimize the problem.
It is unlikely you have any liability for your sons possession of marijuana unless you are facilitating his use or possession of it.
DJJ will evaluate what the sentence should be if he has to plea. But, they might offer him a diversion program. When you go to Court, you should have an attorney with you to discuss what they're offering and whether it's fair. You may have to maintain a not guilty plea to try and negotiate with the prosecutor. Worst case would be juvenile probation and a conviction.
