Dad died--my stepmother won't send me a copy of Dad's trust

My stepmother's attorney says that I have to prove that I am a beneficiary of Dad's trust--the trust was originally executed in Neveda--my stepmother says she is the executed--until she dies, my brother and stepbrother become executors-- As the only daughter, I've been kept in the dark about everything--the stepmother has three sons-- prior to his death, My father assured me that he had taken care of his children--he loved me- Don't I legally have a right to see Dad's trust/addendums/any changes? Thank you, MK

I'm sorry about your father's death. In California you do have a right to see a copy of the trust. But even if the trust provides for you, keep in mind that your stepmother probably has the right to spend all of the trust's assets before her death if she needs them for her "health, support, maintenance, or education". And she probably does not have to provide you with any information as to what those assets are or how she's spending them. If you've made a written request for the trust and your stepmother fails to provide it, then you can take her to court to "compel" production of the trust. Be prepared to spend $2,000 to $4,000 to do that, though. The information you obtain at this site is not, nor is it intended to be, legal advice. You should consult an attorney for individual advice regarding your own situation.

I believe you always have a right to see the Trust document. You may have to go to court to impose your request. Speak to an estate lawyer who is local to you. Good luck.
