Is there any liability for an estate attorney who fails to close a simple estate within a reasonable amount of time?

My father died 5 years ago. We hired an estate attorney to settle the estate. After 5 years and numerous unanswered phone calls, the estate is still not closed. Only after I closed the estate account and notified them, did we get a response. The response was a bill which they referred to as an "informal settlement". We beneficiaries choose to ignore it especially because the inaccuracy and the lack of detailed accounting sound too fishy.

There is no financial liability unless you can prove damages. Have the executor send a letter and demand a proper accounting from the lawyer. If the lawyer is the executor, sned the letter yourself. A bill is not a settlement, but the beneficiaries can informally consent to closing the estate without a formal accounting. If you want a formal accounting for the estate and an itemized bill and don't get either in a reasonable time, file a grievance with the local disciplinary authorities. Neglecting client matters is an ethical violation.
