Fathers rights to child custody/support after 12 years?
Anonymous5 views1 answers
I didn't know I had a son for 12 years. He lives in a different state, his grandmother has full custody and I was ordered by a NC court to pay childsupport. I have no way to contact the child but I would like to build a relationship and maybe even file for partial custody. What are my rights as father and how does the fact, that this child was withheld from me for this long affect my case? I also have reason to believe, that the grandmother is not a good person and has lied on several occasions and might be using the money for her own good. Thank you!
You can file a custody proceeding if one has never been filed, or a motion in the cause if one was already litigated before. If there was previous litigation over custody, you were obviously never notified or actually served with the papers. You can also file paperwork to legitimate your child. Any local Family Law attorney can help you in Sanford. If the grandmother is the current custodian that helps you because you as a natural parent normally have a paramount right to the child. If grandma has bad habits, then even better. Call a lawyer.
