Need some help dealing with DUI ramifications for non-California resident and expungement info.
Anonymous2 views3 answers
Need a recomendation on who to speak to immediately about the following:
1. Wet reckless in CA and it's affect on Washington State resident and licensed driver.
2. CA DMV's jurisdiction over my WA license (including CA DMV's letter of administrative suspension that I surrender any license in my possession).
3. If I don't follow up with CA DMV administrative suspension letter (because WA has never acted on it) have I commited another crime?
4. The court clerk says my DUI arrest case is closed now that probation is over (probation actually ended 3years ago). Can I pursue expongement? Is it still possible if I haven't followed up with CA DMV on reinstatement.
5. Would I be notified if I had violated my informal probation or if I had a bench warrant?
Need answers/help to hire right attorney.
I'm not sure I understand what difference it makes where you were arrested in CA. CA and WA are both parties to the Interstate Drivers' License Compact where participating states share drivers' information. To find out the effect of a CA wet reckless in WA, you'd have to speak to a WA attorney. If you didn't follow up on the DMV administrative procedure then you can't get a CA license until you do. To determine the effect in WA you'd again have to speak to a WA attorney.
You could get an expungement if you hadn't reinstated your CA license. You're not obligated to do so but if you do you'd have to comply with CA DMV requirements. It is not a condition of probation that you get a CA DL.
If you violated your probation you almost certainly would have been notified or arrested. Since you are at liberty I assume you didn't.
There are two issues that you are dealing with here. 1. The DMV – and in this case two of them Washington and California DMV. 2. The California court system. The good news is as I read your question is that the California case is completed. You are no longer on probation and yes you can seek an expungement of the case. You have not done anything that would violate your probation and therefore there is no pending probation violation. The issue that you face is dealing with the California DMV. Anything the California DMV does against your license will affect your Washington License. You need to find out what you have not done and complete it so that you can get your license issues taken care of. An attorney can assist you in dealing with the DMV and seeking an expungement of your criminal record.
