I had a 2nd dui in 2003 and a driving on suspended 2006. I have paid all my fines and need to know if my offenses were prior to the driver resp fee law would I still be responsible for those fees? thank you
Go to this link: http://www.michigan.gov/documents/DRBrochure_88983_7.pdf. You are going to have to pay some driver responsibility fees for the DWLS from 2006. I would need more information to know if you incurred driver responsibility fees as a result of the 2003 DUI.
I would need more specific information in order to advise you regarding reinstatement of your driver license. You may call me at (248) 306-9759.
Only driving offenses on or after October 1, 2003 qualify for driver responsibility fees.
As to how to get your license reinstated, that a far more difficult issue. I don't think your problem is driver responsibility fees. You said you were convicted of an OWI 2nd in 2003. If the prior offense occurred within 7 years of that 2003 offense, you're revoked for life. (That's typically what an OWI 2nd is... but if the conviction fell outside 7 years, then you were convicted of your second first offense for licensing purposes... but maybe that's confusing.)
After a second drunk driving conviction within seven years of a prior conviction, you may apply to have the lifetime revocation set aside by requesting a hearing with the DLAD / DAAD. I have a website dedicated to this process: http://www.michigan-drunk-driving.com/drivers_license_restoration/ It is not an easy process, and you bear the burden of proving your case. If you lose at the hearing, you cannot reapply for another year. Best to call my office or someone else who does a lot of license restoration case work.
