If you are saying that you are going to hire your previous attorney for the next phase ( trial) You can write a letter to the Court requesting a continuance so that you can aquire the funds necessary to hire the attorney. My guess is that you would not be granted the continuance but its worth a try. What ever you do if you do not receive written confirmation that the PTC is continued show up and request the continuance in person. Most Judges will give you at least one opportunity to continue the case to get the attorney. However if you can't at all afford the old attorney then start looking for new counsel ASAP. You may very well be able to locate an attorney who is both well qualified and less expensive than the old attorney. Look here on AVVO and check with the PA or York County Bar Association. You need to file a continuance. You can obtain a continuance form from the Court Administrator's Office on the 4th Floor (I assume you are in York County based on the location identified above) Or, you can appear that the PTC and advise the Asst. D.A. of the circumstances and he/she will provide you a continuance form to sign. I certainly understand your attorney's reluctance to enter his appearance on your behalf until he is paid, but his unwillingness to advise you of how to request a continuance on your own should cause you some concern.
