I have file 1-130 and received first "notice of action I-797" acceptance letter. What is the process time for approval of I-130

I have filed I-130 form for my husband who is currently in India. He was never in US before. I have received I-797 form saying that they received my I-130 and also they gave me case number. Some how online case status doesn't work and I have called USCIS about it. They said it is unavailable online but my case in under process. It's been month and half... I have not heard anything about my case. Is this normal? Do i need to contact any lawyer about my case? How long does it normally take to approve I-130 form? I am little nervous as well as confused. Please help.

Usually between 5-6 months. The first step is still not too difficult but once the I-130 is approved the next step is the NVC-National Visa Center, a clearinghouse here in Kentucky that is part of the US State Department. Their a hassle and I recommend you hire competent immigration counsel to handle that part. We're available or other colleagues on this site. This second step approximately takes 2-3 months but is entirely dependent on your proper submission of all supporting documents and their a very tedious agency to deal with. They will not send your husbands file to the US Consulate/Embassy until you fulfilled every minute detail of their very convoluted and confusing oftentimes repetitive demands on forms which require a very detailed deciphering to figure out what their asking for and often they will ask for the most unreasonable documents even though you cannot procure them from India for instance. BUT if you have all his original pertinent documents such as birth cert etc. than you should be ok but I still recommend getting competent counsel to help you. All in all it will take up to a year (12 months) before he can hopefully join you here in the US.

This is absolutely normal. Usually takes about 3-4 months, but in some instances can take longer. You will receive a letter once your I-130 has been approved. If you do not hear from them in 6 months, you should contact them. After y our I-130 is approved your case will be sent to National Visa Center, and you will get further instructions on how to proceed. It is always a good idea to speak to an attorney and have him/her review your documents and assist you in this matter. Good Luck.

It depends on which service center is processing your case. Most service centers are currently processing I-130s within 5-7 months. Call USCIS if you do not receive a decision by mail within the current case processing times for your service center (which is listed on your I-797).
