Do probation officers have the right to detain people in a house who are not on probation when they are doing a home search?

I am the state supervisor for a sober living house orginization and we have members in our houses on probation and drug court. The P.Os stopped by to do a home search and made everyone in the house even the ones not on probation put there hands up and sit in the living room like we were all under arrest and Im a staff member not a client. They detained us when I feel they have no authority over people who are not on probation am I correct?

They have no authority to detain you or otherwise interfere with your freedom. You should report the incident to their supervisor.

It sounds pretty invasive, but they may have the authority to do that. This is similar to when the police are conducting an investigation on the side of the road and they are telling bystanders to step back, get out of the way, not to interfere, etc. It seems more invasive when it is all unfolding in a house. If they were unprofessional, take it up with their supervisors. If you feel a line was crossed at some point, you may want to consult a civil rights lawyer, but I don't think they will be too interested if the case is not egregious enough.

It certainly appeared so. You may discuss that potentially unlawful false imprisonment and unlawful detention episode with a civil counsel licensed in Indiana for further legal options.
