Court ordered health insurance in a divorce
Anonymous4 views3 answers
my ex husband was ordered in our divorce to obtain health insurance for our child yet he did not do so. The child has been covered under my group health plan in Illinois. Can i collect the amounts taken for the child in court? If so how do i determine the amounts aloted for his premiums alone?
You need to get back to court to modify the order regarding insurance so that you cover your child and your ex pays for the dependent coverage. Go back to the lawyer who originally handled your divorce or hire new counsel. Do this ASAP. You might also consider asking that your ex be found in contempt of court. Your lawyer will know how to do that and if he is found in contempt, your ex will have to pay your attorney's fees..
contact the insurance company. ask for a letter that says how much the premium is for your child. that is the amount. then ask the court to order your ex to pay that in addition to the child supt. then do a new notice to withhold income including the amount of the health ins.
have your lawyer do this for you to make certain it is done correctly.
