My ex has had DCFS called on her 3 times. She is claiming in her declarations that it was me. It was not me. She has been trying to convince the court that it was me in order for me to have custody taken away from me. Being that it wasn't me and being that the judge has told her that nobody knows who the caller is and that it is against the law for a DCFS worker to reveal the identity of the caller. there for by her making this statement to the courts is in fact her making the false allegation. While your inquiry is a bit vague, I gather that your ex-wife has had child abuse or neglect referrals made against her, and that she claims you made those referrals, specious or not. The Court you speak of is, I assume, is either the Los Angeles County Juvenile Dependency Court, which would only become involved if the DCFS found the allegations made against your ex to be founded, and therefore the DCFS filed a petition in the Juvenile Dependency Court, or you and she are doing battle in Family Court. Either way, the Court is correct - the DCFS may not disclose the identity of the referring party. Hence, your ex's assertions that you made the referrals are either false or the DCFS' emergency response CSW told her it was you and thereby violated the law. Can you use her presumably false assertions to seek a change in what appears to be a shared custody order, and to attain an order for sole physical custody in your favor? Well, the answer is maybe, You will need to address that question to the Family Court via and Order to Show Cause request, or to the Juvenile Dependency Court, if that be the forum of which you speak, via your appointed or retained attorney.
