My father is a Permanent Resident. He is going to petition my mother and I. Now i have been here in the US since 1996 and i will be turning 18 in March 2013, so i was wondering how long it will be before the petition is approved or denied?

It depends on what country you are from. Also do not forget relative petition being approved is only the first step. Once it is approved, you must wait for visa to become available (which in your case is about 2 years based on the visa bulletin). When is your father eligible to become a citizen? I suggest you contact an immigration attorney who can give you a more detailed advice based on your particular situation.

As my colleagues said it depends on your country of birth. Your father should contact an immigration attorney before he files your case and to see if you are eligible to adjust your status in the US. Some questions that that spring to mind : Are you in the US legally? Are you considered grandfathered under 245i? Your case might not be a simple matter, so consulting with an attorney should be your first step.

Before your father files you need to asses whether you will need consular processing or can adjust in the US. How long depends on where you are from. Also when and if your get citizenship. Also when and how he got his green card. Talk to an immigration attorney before he files.

There are several issues here. How long does your father have his green card? Will he be a citizen soon? Also, I need to know what country you are from. Is your mom in the US too? Did you arrive in the US legally? I would suggest that you call an attorney so that he/she can better evaluate the information. Our office provides free telephone consultaions. You may call anytime, Rochelle Inger 845-270-0601.
