Would I serve any jail time b/c, i just got a DUI, hit & run and .20% of alcohol while on informal probation for a leaded cane?

4 months ago I was arrested b/c police found a leaded cane in my car (22210 PC). I was convicted 1 month ago. The charge was reduced to misdemeanor b/c it was my first charge ever and sentenced with 3 yrs of informal probation and 26 days of cal trans. A few days ago police stopped me because of DUI, .20% of alcohol and hit and run. I stayed in jail for only 12hrs. What can be the worst scenerio? How long would i serve in jail if court says so for violating my inf. probation and for the DUI and the other charges? I already paid all my fees and did 1 day of Cal trans.
Jail is always a possibility, especially when you're on probation when you commit a new offense. The good news is that the two crimes are not in the same class (you'd be in a different position if you were looking at a new weapon offense).
The downside is - a high blood alcohol level, hit & run and you are on probation for something - recent probation.
You absolutely need a lawyer. You only have 10 days to contact the DMV and request a hearing or they will automatically suspend your license.
Without being on probation, you wouldn't go to jail for the DUI, and may be able to still avoid it as Mr. Dane said. Keep doing your caltrans and get lawyer to help with the new case.
You need an attorney ! You violated probation and got a DUI with a very high BAC level. You face possible jail time; fine; drivers license suspension by court and DMV ; alcohol school and installation of an IID on your car.
Get an attorney !

The truth is the hit and.run dui.alone with a high BAC has the potential to land you in jail the probation violation just adds insult to injury
You need to contact a good Attorney here they can make a difference.
You're definitely looking at some jail time, however the DUI may be hard to prove depending in the facts of how you were stopped. The time between your first charge and your second charge is so short that the judge may put you behind bars. Feel free to call me with any questions.

Jail time is a definite possibility, and the prosecutor will likely push for it. There are just too many aggravating factors here for the prosecutor to just let this one slide. Get an experienced attorney and take this matter seriously.
