i recently worked at a daycare and my pay was minimum wage. but when i looked at my paystub two pay periods later i saw i was only getting paid $7.50/hour. i talked to my manager so she raised it up to minimum wage which is $7.65. can i ask for back pay or are they in the right standing?

Please understand I am not admitted to practice in your state so my comments are general and do not constitute legal advice. However, I am confident that yes, you are owed this money since you were being illegally underpaid and I do think you should add up the money and submit a statement to your boss.

Absolutely you should ask for the back pay AND they can't punish you for asking for it! In fact, under the fair labor standards act, you can go back two (or possibly three) years. And don't forget in Arizona, the minimum wage goes up to $7.80 per hour January 1, 2013. That's right around the corner.

If your employer will not voluntarily agree to back pay, then you could file a wage claim with the Arizona Department of Labor. I've included a link to its website below. Good luck. http://www.ica.state.az.us/Labor/Labor_WagClm_FAQs_Wage_Claims.aspx
