I was consulted by immigration lawyer and he advised my attorney to bargain for criminal trespassed 2 to avoid immigration consequences! I plead guilty to that and I was sentenced for 2 days community service, fine and theft class! My immigration lawyer told me i can apply for citizen in 3 years because I married to US citizen! My concern is if I leave this country for vacation and reenter am I going to face inadmissable or can immigration put me in detention jail! My immigration and criminal lawyer are little annoyed but I still not over it! My case almost closed but I'm freaking out too much when I think about what I went through! I have established here and I have small children! Please help! I'm afraid if they going to hold me in detention if I leave and coming back!
You are correct: You're "freaking out too much".
If you're that worried .... don't leave the US for a vacation ... until you become a US citizen.
PS I'm assuming/hoping that your immigration attorney is a member of AILA: www.ailalawyer.com

Your immigration attorney is correct. If you have been convicted of theft 3, that would have been a problem. However, Criminal Trespass 2 is generally considered an offense without any serious immigration consequences. It is not an aggravated felony. And from what I recall, it does not fall under "crime of moral turpitude". I agree with the above attorneys as well.
