No, you won't go to prison just because you cannot afford a lawyer and probably not on a second DUI, either. A second DUI conviction will usually carry a short jail sentence up to 60 days. But that is county jail, not prison. That is only if you are convicted. You should ask the court to appoint you a lawyer. They may charge you $50 but that is all. You won't have to go forward without an attorney.

If you are still on probation, you will more than likely have a probation revocation hearing where the judge could revoke whatever you have left on your sentence. You will also be looking at much stiffer penalties for a second DUI and I suggest you contact a DUI attorney immediately.

Not prison, but depending on whether or not your probation is revoked, or whether the suspended license and DUI charges were within 5 years, there may be county jail time involved. See if you can get a public defender and discuss all of the facts with them. You may be able to get some or all of the charges reduced, which cuts down on the possibility of jail time or may shorten it. Also, discuss the impact of the charges and/or what a plea or conviction will do to further damage your ability to get your license reinstated.
