3 views 3 answers
I was arrested in 95 for a narcotics sale sentenced in 96 to 30days and 5yrs probation, I violated and went away for 20 months, in 02 I was re-arrested and convicted in 03 for an attempt to posses and went away on a 1.5-3yrs term, I was released on parole, 4 months later I was charged with conspiracy (narcotics). I was in custody for 8 months fighting parole and I was able to make bail. I was put back on Parole pending the outcome of my case but while I was out on bail, I maxed out on parole and I was successfully discharged. I ended up receiving 25yrs probation. I've never been arrested Again and since then I have been Employed in the mortgage and RE Industry learning as much as I can. Recently the laws changed and I was unable to get licensed as a banker because of my conviction. HELP ME

A person convicted of a felony is automatically barred from getting a real estate license in New York State. While the automatic bar can be removed with a Certificate of Relief from Disabilities, Certificate of Good Conduct, or an executive Pardon from the governor, the agency granting the license still has the right to deny the license if the conviction was job related or might indicate that the applicant poses a risk to people or property.

If you have 2 seperate felony convictions you are not eligible for a Certificate of Relief From Civil Disabilities. https://www.parole.ny.gov/certrelief.html Check with the licensing bureau to see if your felony conviction is an automactic bar to getting a license.

As you might've gathered from the other answers, you've got an uphill battle. A felony conviction will automatically bar you from obtaining the professional license you are seeking unless you can obtain a Certificate of Relief from Civil Disabilities, or even more rarely, an Executive Pardon, but even then, a vast amount of discretionary authority is given to the license issuing authority.
