What are the chances of a person going to jail for criminal damage second degree?
Anonymous3 views3 answers
Damage done by husband (James) and room mate (Billy). Evicted from house. Warrent put out for leesee(s) (James) AND (Kristina). They turned them selfves in and were arrested. They posted bail. No lawyer. Late to first court date, they rescheduled. What are her chances of (Kristina) going to jail for second degree criminal damages? She didnt even do the damage.
Kristina needs a good lawyer to defend her against this charge. If she has a clean record, she is unlikely to go to jail on a criminal damage charge, unless there is an extreme amount of damage that could not be repaid on probation. However, if convicted, she will certainly be saddled with a hefty fine (including court costs and piles of surcharges) and restitution for the damages. If she doesn't pay this money, then she is in jeopardy of being incarcerated on a probation revocation. Her maximum exposure in the case is 5 years in prison. Kristina needs a lawyer. Jail is always looming out there. Why? You never know what will happen in these things. You have to take action to keep it from happening. There is also a potential civil proceeding to think about. That might end up to be worse than jail time.
