As I stated records are lost and therefore treatment was incomplete, time has been lost and I am stuck in limbo. Brain injury is still present and absolutely no help in recovering from injury. Yes it is unbelievable and unusual, but it is what happened, with witnesses in the medical profession at the hospital on my side to add.

There should be an electronic version of your medical records. It sounds like there are a lot of issues here. How did you get the brain injury? You should schedule an appointment to sit down with a lawyer to discuss everything.
If you had a personal injury claim when you were struck by the car and had a lawyer or made a claim on your own for that accident, perhaps your lawyer or the insurance company for the driver will have records. Also, affiliated specialists with privileges at hospitals sometimes maintain their own, separate records as (sometimes) do health insurers. It is not clear whether you can recover records from other sources and/or whether you are making a claim against the hospital and this is possibly a situation called "spoliation". You should definitely see a lawyer in your area and explore all the options and possibilities and do that right away. Good health and good luck!
