I'm on my way on applying for AOS-864 for I-130 visa for my husband. I was employed as a registered nurse 2010-11, being paid $28.41/hr x 40 hrs, able to file taxes as well. This year due to pregnancy, I stopped working and just recently employed (nov. 26) as a registered nurse with a wage of $21/ hr x 32 hrs. What do I need to put on my individual current income?

Filling out immigration forms takes practice and understanding of the law. You should review your specific facts with your attorney to make sure that your petition is filed properly. It is unusual that a person would stop working the whole year due to pregnancy. You need to prove to USCIS what your expected income for the next several years will be. You likely will need to provide copies of prior years' income tax returns if those returns show an ability to earn income. The Form I-864 asks what is your annual income. If you will be working the whole year at 32 hours a week at $21 an hour, then you multiply out the numbers for the whole year. Another section of the form asks what numbers were reported in your income tax returns. You need to be able to explain the big difference between your 2012 income and future incomes. If you can find a joint financial sponsor, that may be the safest route to go.

These forms can be tricky; however, put your annual income for your current job. Make sure to get a job letter for the interview along with some current pay stubs.

In these cases, we advise our clients to put their current calculated annual income (about $60,000) and include: 1. A letter from your current employer confirming your compensation and position, and tenure, even if it is a new job 2. Past 3 years of tax returns 3. Past 3 pay stubs If CIS needs more information, it will ask in a Request for Evidence (RFE) or in the Appointment Notice letter. At the time of the interview, bring your 3 most recent pay stubs, and your child...that should explain your leave from work!
