The degree does not necessarily affect the points but affects the jail. An m1(1st degree misdemeanor) carries up to 180 days in jail and some carry mandatory jail such as OVI or driving under OVI suspension. M1's also carry up to a $1000 fine. A fourth degree misdemeanor (m4) carries up to 30 days in jail and a $250 fine. Both could probably carry a potential if not a mandatory license suspension. Without knowing the exact charges it is tough to say. Either way you should hire an attorney. Good luck.

The offense degree has nothing to do with the points the BMV will assess administratively, only the severity of the offense itself. M1 means first-degree misdemeanor, the most serious type, punishable by up to six months in jail. An M4 is punishable by up to 30 days in jail. You should definitely contact a lawyer if you've been charged for anything other than an MM (minor misdemeanor) violation, which is punishable only by a fine.
