What are my rights in getting a legit package back that was seized by postal inspector?

Business 2 views 4 answers
I recently moved to Cali. Currently no job no bank account etc so my friend sent me cash through the mail. The postal inspector seized it, claiming it was for drugs. All the information written on the package is legit as far as addresses and contact information. They made me sign a form stating that I dont claim ownership of the package and dont know who sent it. I know it was a friend but was not sure who sent the package. He took up a collection to help me out. I was asked how much and I stated around a 1000$. There was more. I was not aware of the total amount that was being sent. Is all that money lost? All those people that chipped in for nothing?

Well, you admit you signed a false declaration about ownership and don't know who sent it. No one forced you or "made you sign". Your whole story lacks credability.

The major question is why did you sign the form disclaiming any ownership interest in the package? Given what you have described, if you are interested in pursing the matter, it would be in your best interest to seek local counsel in California to assist you in pursuing the matter. The best place to start is the California State Bar Association in finding such an attorney. You may also be able to locate an attorney by using the internet. Best of Luck!

The money may not be lost forever but it is going to be in the U.S. government's bank account for at least the next 4-6 months. You have rights though. The government must prove by a preponderance of evidence that the money was either (a) being used to facilitate illegal activity, or (b) the proceeds of illegal activity. I handle all types of asset forfeiture cases. Call me anytime to discuss your options and the process.
