Ruth carelessly parks her car an forgets to put it in park. The car rolls down the hill, knocking down an electric line. This sparks from the broken line ignite a grass fire. The fire spreads until it reaches a barn one mile away. The barn houses dynamite, and the burning barn explodes, causing part of the roof to fall on and injure a passing motorist, Jim. Can Jim recover from Ruth?

Yes, Jim can recover. The accident was caused by careless actions of Ruth and she is responsible for the damages. If her insurance does not want to cover the cost then it is possible Jim's might cover the expenses. In this case, Jim's insurance company would attempt to recover the money from Ruth or her insurance. I would suggest Jim seek legal advise before taking any settlement.

Yes -- but let's be honest: did this really happen in Key West (or anywhere)? There isn't a mile of contiguous grass to ignite until you get to Marathon Key! It is a fun hypothetical question though....

This sounds like a homework question for a law class in school. Your best bet is to do your own homework and research it yourself instead of asking someone else for the answer. You'll enjoy the task. Good luck.
