Unmarried. Indonesian. 27 years old. i've staying in US about 5 months with tourist visa. My step Dad is a US citizen and my brother is a Green Card holder. if my mother filled her petition for me, can i wait in USA? or i must go back to Indonesia? if i can stay here (while waiting the petition), will they (immigration) give me work permit? i am so confused because my family is in US but i can not live with my family here. thank you.
It will take about 5-7 years or so until a visa will become available since you fall under the first preference category. Unfortunately, you cannot remain in the US while you wait for the visa. Speak with an immigration attorney about other possible options for you.

It will take 7 to 8 years for you to be elible to apply for a green card through your mother's petition.
You cannot stay in the US and will not be able to obtain a work permit while you wait. To do so you would have to change status to a visa category that allows you to remain in the country before your current status expires.
To stay in the US, you must maintain non-immigrant status. You cannot maintain tourist status for the over seven years that it will take before you can immigrate.
