Drug court sanction will be ruining my life more than rehabilitating me. What is the best way to handle this without jail time?

I am currently in White Plains City Drug Court. I was initially arrested with under a gram of Ketamine and due to the officers weighing the substance with the bag it came to 1.2 grams which in NYS is a felony. After waiting 6 months to get the results back from the lab, it came back with no weight and I was forced into accepting drug court. I am an editor at a major magazine and own a PR business. I have failed a drug test in the program and they are now mandating rehab . To be honest I never fought this properly due to my busy schedule and if I do agree to this sanction I will lose my livelyhood. Is there anyway to get out of drug court and avoid a more serious sanction? I truly cannot afford to just go to rehab, my job and life will not permit. Drug court is not considerate of this

Did you already plead guilty? You should have a lawyer representing you. You should be discussing this with him/her and s/he could best advise you on what options may (or may not) be available to you.

You need to speak to your attorney who has advised you so far or hire a new one. There are usually options in these situations but the attorney must be knowledgeable and be prepared to fight for you! Courts and DAs do not react well to "I'm too busy for rehab" so I suggest you sit down with a good criminal defense lawyer and figure out your options. If you already pled guilty they may be limited.

I know that in Westchester County drug courts, you have to plead guilty before entering the drug court. If you pled guilty and are currently in drug court, you will have a defense attorney available to you. Talk to that person if you are already in drug court. Perhaps your attorney can negotiate with the ADA. However, the likely alternative is probation, and they can make you do the same thing, that is, go to drug treatment. If you violate probation or drug court, the likely alternative is jail time. You probably don't have time for that, either. Once you are arrested on a drug charge, if you are released, the court will require you to attend TASC who will send you to drug treatment. Testing positive was not wise. Perhaps the drug treatment is not a bad idea.
