Can I take legal action against an officer who issues a wrongful parking violation ?

I recieved a handicap parking violation for using a valid Michigan placard in a vehicle with Texas plates. The right to use an out-of-state placard is described in Texas Code Ann. par. 681.007. I understand I cannot take action against the City of Tyler, but, what about the officer who issued the wrongful citation?

In addition to what the previous lawyers have posted, I would suggest that you seek sending a letter to the City of Tyler regarding the parking attendant. If you ask to file a complaint, then there will be a record of your complaint with this particular parking attendant on file for future complaints from others that may eventually go through what you are going through. The best way to educate these parking officers is to start a series of compaints that grabs the city's attention. You never know, there could be other complaints just like yours and the city may take action on this particular officer, or they may issue memo to all officers reminding them of the law. In this way, you have accomplished something beyond simply getting your citation dismissed (which I hope you do). Good luck.

I suggest you content yourself with beating the citation. Maybe you could make a sign with the text of Texas Code Ann. par. 681.007 enlarged, and put it on your dashboard to educate officers who may be ignorant of its existence.
