he hasn't heard from his probation officer in over a year. He only met him once, my son called him 3 times about a year ago and left messages for him to call him back, he never did.

He can travel, but he should have his attorney contact the probation dept. to notify them of the trip but to also find out the status of the case. I'm sure costs are due and there are requirements that must be complied with. Hopefully, your son has already had his alcohol evaluation, did safe driving school and community service.

Normally, a misdemeanor dui only involves summary probation, or probation to the court. If that is what was ordered, absent something in the court's order to the contrary, he would normally not have any travel restrictions. He should read over the court's order very carefully. As to your last comment about him being charged with aggravated assault....was that a count that was dismissed or is that a separate case that is still pending ?

I am confused about the status of the Aggravated Assault, and would be extremely concerned about not hearing from a Probation Officer for a year. If the Probation Officer can't find him, he could have issued a bench warrant which could certainly complicate travel plans. Have an attorney contact the PO if he won't respond to your son.
