Do I pay the fine?

Business 3 views 2 answers
I was caught shoplifting at a Big Y here in Amherst, MA. I was taken back into a room where they had me sign a Civil Demand Notice and a Notice of Trespass. I was told that I should expect a fine (they told me they were unsure of the amount) in the mail in two weeks. I am 19 years old and this is my first time getting caught for something like this. I have a clean record and have never been in any legal trouble before. I would rather my parents not know about this. What should I do in this situation? The item I took was a protein bar valued around $1.69

You are an adult and you will have to act like an adult now. Tell your parents. You need to get an attorney so that something can be done to keep this off of your record. Don't pay the civil penalty until you speak with an experienced criminal defense attorney because paying that civil penalty to the business may be a part of the deal your attorney can make with the State to help you in the criminal case.

What you are describing is NOT a fine; simply a demand by the store. They are legally allowed to ask for up to $500 if you get caught shoplifting. You however, are under NO LEGAL OBLIGATION to pay that fine. They can sue you in court if they want to get it. If they do, they may also ask for attorney's fees under certain circumstances. If you do pay it, the fact that you paid it may be used against you if you ever get charged with shoplifting from that store. Speak with an attorney to discuss specifics in private and in confidence. Let me know if I can help. Hope this helps and good luck, Law Office of Ilir Kavaja 30 Newbury Street Boston, MA 02116 617-515-5545 www.KavajaLaw.com
