Can I stop a divorce?

Business 2 views 3 answers
My husbanf filed for divorce. I agreed, not knowing why, but after a lot of arguing I was just tired. Now I found things out. I rather want to be separated and see if we can work things out. But we have brought the papers already to the court. They told us that there is a 60 days waiting period until its finalized. We would then have to see the judge. This period is by far passed. Am I already divorced now? Do I now need to talk to the judge? We filed it ourselves, except for the lawyer my husband had in the beinning which my inlaws paid.

First call the District Clerk (or look online) to find out the status of the case, and if a divorce has been granted. If it has, and it has been within the last 30 days you might (only might) be able to set it aside. If it has been more than 30 days, your chances of undoing dwindle to nearly zero. If you are NOT yet divorced, hire a lawyer immediately. A lawyer cannot stop the divorce from happening, but could very well slow it down considerably. Good luck.

You should check on the status of your divorce with the court clerk in the court where your divorce is pending. However, you should know that in the State of Texas there is no such thing as a legal separation. You can your husband can be physically separated, but you will have no orders to enforce monetary support or property issues.

Each state is different. You should definitely obtain the legal services of a Texas attorney to handle these complicated matters.
