I was sued by my credit card company because I couldn't afford to make payments, got a judgement to pay a certain amount

each month back in September 2009 and then I made payments but couldn't afford to, then on November 2, 2012 judgement was rendered to execute my judgement and garnish wages at one of my jobs. I never received a court notice telling me to come to court on November 2, nor notified me that they were intending to take me to court on that date. I would have appeared in court to answer to the case that is alleged against me. Did they violate any procedures by not notifying me that they were taking me back to court? Do I have a case of any kind?

If a creditor has a judgment against you, then the creditor can seek enforcement of the judgment. If you are having problems meeting your obligations, it may be in your best interest to seek a consultation with an attorney that specializes in bankruptcy, It may be possible for you to re-organize you debt in such a way that you avoid problems with creditors such as income executions and other possible collection actions. As a debtor, you would get a handle on what your legal rights are against various creditors and what is necessary to protect yourself against adverse creditor actions. If things get too difficult, people file bankruptcy all the time...it is considered a way to get a fresh start...after talking to a bankruptcy attorney, you should have a better idea on how to proceed. Fighting a judgment is a very time-sensitive matter. I recommend pulling the Proof of Service for the Complaint to see what they are alleging. For example, if they claim to have served you personally when this did not occur, then you may be able to get this default set aside and sue them in return
