Landlord failed to fix SERIOUS habitability breaches, raised rent despite lease, then failed disclosure when hiring P.M.-

P.m. failed to provide identity, payment info until end of month, making tenant appear delinquent in rent. First action, 3 day received in MAIL, falsely stating posted at residence since then, illegal search of premises, threats, and finally they saw breaches, and quit rental contract. If I sue pm can I use owner ad witness, but sue owner later for damages SHE caused prior and after pm took over?

The property owner is the agent for the owner, so if you bring a lawsuit, you need to sue both of them in the same lawsuit. You can call both of them as witnesses in the same civil lawsuit at trial. Note that if you have already been sued in an unlawful detainer lawsuit, you normally cannot file a cross-complaint in the unlawful detainer lawsuit. You have to file a separate civil suit.

Hire a lawyer to address these issues and evaluate the possibility of a lawsuit regarding habitability issues. Good luck.
