Can a defendant go pro se in a DUI court case?
Anonymous3 views3 answers
if a person gets a DUI and has a court date is it possible for that person to defend themselves and not get a lawyer? What would be the outcome? Could they still get a deferred sentence? This person is not eligible for a public defender but does not have enough money to pay $3,00 to $5,000 for a lawyer. They filed bankrupcy 2 years ago.
Although it is technically "possible" for someone to represent themselves on any criminal case, a DUI case is one of the most complicated cases that exists in our state. The penalties can be enormously devestating, including loss of license and up to a year in jail.
Many attorneys will not only offer free initial consultations, but can be flexible and work out payment plans.
I wuold encourage this person to contact my office for a free consultation.
You can, but recall the old adage that a person who represents himself has a fool for a client.
In order to defend yourself you need to know the NHTSA Training Manual inside and out as well as any breath test manuals that might apply. You also need to be detached from the case so you can analyze it objectively.
Good luck.
Is it possible? Sure, usually. But no one experienced in the system would ever recommend it. A lawyer is expensive; but some of the most harsh penalties associated with DUI are financial. A skilled DUI attorney can often pay for themselves with their ability to navigate through the exceptionally complex laws and minimize the penalties to you. Talk to some attorneys about payment plans, and never consider representing yourself unless you have the time to thoroughly research and learn the law that applies to your case.
