Ok tonight i was driving home and there was a road block , they pulled over every car , me been one of them , i gave them the title and insurance, and my International Drivers license. Becuase of when the car was registerd the Cop knew id been in the state longer than 30 days which in the state of florida within 30 days you have to get a Florida license. So he issued me i sitation to appear in court in 3 weeks time. i have overstayed my visa and in florida you have to be a citizen or residant to get a license. He told me to go get my license and the judge will dissmiss the sitation, but as you can see my problem , i cannot cause i am out of status, what can i do , do i go to court or what can i do. I was driving on a valid International Drivers license, but i suppose that doesnt matter , right. Plus if i dont go to court that would make things worse correct , please advise me, please. Thank you

You have a lot of information in your question, let's take it one step at a time. First, contact an attorney, many attorneys deal with traffic infractions and traffic criminal tickets without the necessity of you appearing in court. Second, don't ignore the court date. If you don't hire an attorney go to court!!! You are not going to get deported for a traffic offense. Third, you do not need to be a resident or a citizen to obtain a license. If you have an application to adjust status I-485 pending you can take your receipt to DMV and get a license. Fourth, you are out of status and that is your MAJOR problem. Depending on how long you've been out of status has different consequences. If you've overstayed your visa less than 6 months it may be in your best interest to return to your country. You can do so without triggering a reentry bar. If you have overstayed more than 6 months but less than a year you are looking at a 3 year bar (inadmissible for 3 years) if you leave the country. If you've overstayed your visa by a year or more, you are looking at a 10 year bar (inadmissible for 10 years) if you leave the country. You should contact an immigration to discuss your possibilities for staying in the country legally.
