Judge sending him to ETTF. in Henderson tx. because he was not paying for breathalizer. He has been in holding for almost 3 months. They said his packet got lost. His son needs him.

Very unlikely. Also, judges and prosecutors hear the need for family members and others that rely upon the incarcerated all the time. They tend to get immune to the statements. Their typical response is: "They should have thought of that before they did ___________". When individuals are on probation, they must follow the terms and conditions to stay out of jail or be sentenced to the suspended term of incarceration. Good Luck

Unfortunately once he agreed to probation, he became bound by its terms and subject to the judge's rulings if he violated those terms. You could hire an attorney to file a motion to modify the terms of community supervision and have the ETTF requirment removed. But if the judge has already made up his mind that's what your son needs, he is unlikely to change it.

If a probation has not been revoked, then as Ms. Jaggers suggests a probationer can hire a lawyer to file a motion to amend the conditions of probation. Whether the judge in any given case is willing to do that depends on the details of that case.
