is there any lawyers in manhattan.bronx who deal with tenants that sue landlords for lack or repairs, harassment etc that tell you if you have a case and take it and charge you out of your settlement? (I feel I have lots of proof including a NEW malicious civil court claim) This has worsened my disability and caused me to be on MORE/and or stronger meds, hair fell out on the sides, and I'm extremely paranoid to the point I cant sleep and now have to take sleeping pills. Im just not sure if this is considered "personal injury"

Dear are there any lawyers? Yes. Of course there are lawyers. Tenant lawyers do not usually suggest affirmative lawsuits against landlords for failing to repair because the lawsuit does not go directly to the client's problem: That is repairs that need to be made in the apartment. New York tenants have available an "attorney free" form of lawsuit to have repairs made in the apartment in the context of the HP Proceeding. See: http://www.courts.state.ny.us/courts/nyc/housing/startinghp.shtml Once you have had your repairs made, an attorney could bring an affirmative lawsuit for money damages based on the breach of the warranty of habitability and breach of contract (lease). In that form of lawsuit, a tenant may sue to recover in damages all rent paid to the landlord for a six-year period, assuming the tenant can prove that for the entire period of time that violations impacting on habitability can be proven. That requires a lot of effort by the attorney and can become expensive. The attorney must be reliably certain of a substantial chance at a big win to consider self-financing the client's lawsuit. That type of representation is more likely if you were to sue for a personal injury. If your disability has been documented and you receive money then you may possibly jeopardize your disability income with a win over the landlord. You have a lot to consider here. You don't want to scare an attorney away by describing your state of mind as extremely paranoid. Personal injury attorneys work on a contingency basis if there is real likelihood of success in gaining a large verdict or a settlement. Good luck.

If you are in need of repairs, then commence an HPD action in landlord tenant court and the City of New York will represent you after you pay the filing fee to have the apartment repaired. You can speak to an attorney regarding a personal injury case if you have a doctor who will connect the harassment to your medical and psychological injuries. Good luck.

Yes. There are many lawyers who will take it on contingency but the proper thing to do like another suggested here is to call NYC HPD and they will send an inspector who will document it and proceed against the landlord as necessary.
