Can I petition for permanent overnights?

3 views 1 answers
If my daughter's dad relinquished all overnights to me during the entire month (he gave me a one-day notice to ask me to take over nights) because he is going to be moving into one bedroom (in a house with an unrelated family) with our daughter can I petition to permanently have all overnights if I live less than a mile away and my daughter has her own bedroom at my house (that I own)? Our daughter is six. Might a judge see merit in this petition? Thanks.

Consult your local bar association for referral to an attorney who specializes in family law. If the father is unable to have the child sleep in a separate bed, and he is able to have frequent and liberal visitation with the child during the daytime, a judge might see merit in having the child sleep in her own room 1/2 mile a way at your home. In addition, the father might agree to have the child sleep in her own room, as long as he is not denied access and visitation with the child.
