Severance Package

Employment 2 views 2 answers
My company is going through a merger. My entire department was either laid off or applied for other positions and got the job. I wasn't offerend a severance package like the others but instead placed under a different supervisor with lower level job responsibilities. I am not happy with the job change or the new supervisor. I believe I was placed in a new role to avoid being paid a package and unemployment. What can I do?

A merger is scary for anyone. You may not have many options here, but you can try to see if you could get a severance package instead of the job -- but the company is not required to give you either -- it could just let you go without any severance. Is there someone trustworthy and in a senior position from your current employment that you can speak to about this, that might be able to assist you? From a strictly legal perspective, there is not much that can be done, unless you can show this is something discriminatory in how you are being treated. In this economy, keeping a job (even in a lower position) may be better than the alternative.

You give very few facts or indicate whether or not you applied for any other positions in the company. Unless you were being treated differently than others based upon discriminatory factors, you are probably lucky you didn't lose your job; unemployment doesn't pay very well. If you didn't have this job, you would probably have to start looking for another job. If there was an employment policy manual, it is important to review the same. If you are in a Union, you can speak to a Union Attorney or representative in regard to your concerns.
