What can I expect at a Bench Warrant hearing?

Criminal Defense 2 views 4 answers
The case is from 2008 for driving without a license, and my boyfriend missed 2 other bench warrant hearings. Does anyone know if they will send him to jail for it or could he possibly get probation, a fine, or community service? Also he is an illegal immigrant. He lost his job and was homeless for about 3 years which is why he wasn't able to go to the 2 hearings.

Sounds like he's trying to give a judge no choice but to jail your boyfriend. He should be in immediate consultation with an attorney experienced in both criminal law and immigration law. Good luck.

OK, so 3 missed hearings and a bench warrant over no license? Have him contact the clerk and request a PD when he appears. Call up and chat with an immigration attorney prior to appearance.

He needs an experienced defense attorney, especially in a conservative court such as Long Beach. Many reputable attorneys provide a free consulation. He should meet with one immediately. The homeless excuse is not going to fly with many of the judges in Long Beach.

well, a bench warrant recall is always up to the individual judge. your boyfriend could go home that day, or not. lack of a license is not a huge offense but courts, especially Long Beach courts, really don't like it when you don't go to court. He really does need an attorney and he does need to clear the warrant. if he has any police contact whatsoever he will go straight into jail and not get out until the judge lets him out. if you need someone to go with you feel free to give a call.
