I keep getting phone calls threatening me with being served papers for a civil suit over a day pay loan from over 5 years ago.

They tell me that they will and have called people that I know they called my ex mother in law and told her that she would be going to jail for not telling them where I was at. They tell me they will be at my house sometime that day but most of the time within 24 hours. What can I do?

I have heard of these threats from pay day loans often. Typically, the calls come from off shore or from fly by night companies. If the people are with a company within the United States you can file a claim against them for the violation of your rights under the FDCPA and FCCPA. I would suggest contacting an attorney who practices in this area for a consultation about your rights and to review who the calls are coming from to see if anything can be done.

Check the court records to see if any lawsuit has actually been filed. If no lawsuit exists, the threat is totally bogus. Many courts post all their records online so you don't even have to go down to the courthouse. If no court records exist, this claim is a violation of debt collection laws and you should contact your state government to file a complaint against the debt collector making these false statements. Hope this perspective helps!

If they have left messages on your answering machine or on someone else's answering machine that you know, save the messages. If you have received letters regarding the debt, save them. Take a copy of the messages and the documents and consult with an attorney.
