If I pick up a panty on the ground belonging to someone else is the reasonable time of discovery that applies to the discovery rule for petty theft when the owner lost the item because that is the time of dispossession? If I later dispose the panty does the statute of limitation begins to run and I can no longer be sued in a civil court after a reasonable amount of time? If what I do to the panty is in the house for personal use can I still be sued for sexual harassment without a victim? P.S. I put Davis, California because that is where I used to live and to post the question. I currently live oversea and if that is a problem please remove the post for me.

Perhaps the safest bet is not to pick up someone else's panties or property.

I certainly understand why you have kept your question brief and somewhat vague. However, this is something that I think you will need to address with an attorney directly so that many more facts can be learned before you get an opinion about whether or not you face potential exposure. Good luck to you.

As an employment law attorney, I cannot help you with the answer to the first two questions. I can tell you that in employment law, picking up panties off the ground will not constitute sexual harassment. A victim of harassment must either 1) be exposed to a particularly egregious single act of harassment, usually involving unwanted touching, or 2) be exposed to an environment in which harassment, by way of words, pictures, even staring, becomes the employee's frequent work experience. In this case, it is not apparent that there is a victim who a) belonged to the panties, b) saw them being picked up, and/or c) was offended by the act. I think you can sleep well now.
