Can a previously approved I-140 that was revoked (due to successor-in-interest and ability to pay issues) be appealed?

Case: EB3, consular processing. I-40 was already approved when sponsoring company was bought out by a new company. New company is willing to continue sponsorship. NOIR was received from USCIS with a request for evidence to prove successor-in-interest and ability to pay. Evidence/documents were submitted. After more than 60 days, received email from USCIS that the previously approved petition is revoked.

There is a 30-day window (from the denial date) to file an appeal. Like my colleagues said below, please consider having an attorney review the full file and advise.

Your employer needs to retain an experienced immigration lawyer to review all the facts, advise them, and handle the case. Your employer can find one through http://www.ailalawyer.com .

Repeat questions require repeat answers ... hire an attorney to analyze all the papers. If there was an attorney working on the papers ... pay another for a second opinion.
