What can be done when someone you have an order of protection against calls CPS on you?

My mother in law got angry that my husband and I didn't visit her one day and decided to start harassing us by the phone and saying she was going to call cps among other harsh things she said. We've previously called about phone harassment and are getting an order of protection by morning. What can be done if the order has started and she calls cps?

There's pretty much nothing you can do to stop her if she calls Child Protective Services. DCS is required to investigate any reports that they receive regarding the possible abuse or neglect of a child. An Order of Protection is designed to protect persons who are relatives of an abuser or stalker or who have been in an intimate relationship with an abuser or a stalker. So, unless there's more to your situation than just the threat to call DCS CPS or repeated telephone calls, then it's possible that the judge won't grant an Order of Protection. However, if you are receiving unwanted, harassing telephone calls, it is possible that your mother-in-law may be guilty of the criminal charge of harassment. If the problems continue, you may want to talk with the police and/or your county's District Attorney General's Office to see what you would need to do to pursue criminal charges. if you are caring properly for your child or children, and the CPS worker investigates and finds nothing wrong, then the complaint will be closed as unfounded. On the other hand, if you have reason to believe that the CPS worker might find a that you are neglecting or abusing your children, then you should consult with a local attorney before you even talk with the CPS worker. Good luck to you, and please remember to mark answers that are helpful to you and to choose a "Best Answer" from the responses you receive.
