Qualifications for Chapter 7 Bankruptcy

Chapter 7 Bankruptcy 2 views 2 answers
I currently have over $12,000 dollars in debt and am wondering if I qualify for Chapter 7 liquidation and discharge. Roughly $9,000 of the debt is from an auto loan where the car has already been repossessed and sold at auction. The remaining debt is unsecured credit cards. I currently am not working, but even when I am, I do not make more than the median income for California. I also have no assets at all. Any suggestions would be appreciated.

If I were you I'd schedule an appointment with a bankruptcy attorney who does chapter 7work and gives free first consultations. He/she will first be able to tell you if you pass "The Means Test" which is an income and expense based test. You must pass this to be eligible to file a chapter 7. The income part of the test is based on your income the last 6 months (not just the fact that you are unemployed today).

There is no minimum or maximum amount of debt necessary to file for Chapter 7.
