my question can my husband apply I-130 for me? Yes, but you will have to wait until he is a US citizen in order to be able to adjust status and become a legal permanent resident. what is my status now? Out of status You should retain an experienced immigration lawyer to review all the facts, advise you, and handle the case. You can find one through http://www.ailalawyer.com.

As you stated your status now is pending asylum. It will take a long time for your husband to file for you since he is a green card holder. It is probably best to wait for a decision on your asylum case. I highly recommend consulting an immigration attorney.
