For the next fiscal year, ending September 30, 2010, there still are visas available, and so it is not too late to file a FY 2010 H-1B application. For the fiscal year beginning October 1, 2010, applications may be made starting April 1, 2010 and continuing until all the H-visa numbers become exhausted. In previous years, all H-visa numbers for an entire year have become exhausted immediately at the beginning of April, but with the severe recession in the U.S. this year, the H-visa numbers have not yet been exhausted.
