Even today, there are not as many female officers serving on the various police forces around the country. The law does not generally require that a female officer be present for an arrest. Are you alleging that the officers acted outside the scope of their regular duties. Once you retain a lawyer in Arizona, your attorney may be able to subpoena any video of your arrest at the scene. The video may show how the officers acted with you on the scene. Different jurisdictions have different procedures. Please make sure to get an experienced DUI defense attorney for your case.

No, there is no Arizona statute that requires a female officer to be present while you (a female) are being investigated and/or arrested for DUI. However, if your physical person is being searched (for contraband and/or weapons) for more than a routine 'pat down' search for weapons, most police departmental policies (throughout the nation) call for a female officer to be present.

A female officer does not have to arrest a female suspect. In my experience, the majority of DUI arrests are by male officers. A female officer, if available, may be called upon to provide assistance to avoid any potential allegations of inappropriate behavior on behalf of the officer. However, typically there is no policy and certainly no right to be arrested by a female officer.
